PETITION AGAINST THE COMMISSIONER OF POLICE, DELTA STATE (OLUFEMI ABANIWONDA); DEPUTY COMMISSIONER OF POLICE (ADMIN) ADEGOKE ABDUL; ๐๐ ๐๐๐๐ ๐ ๐๐๐๐๐๐ (๐๐๐๐) DELTA STATE POLICE COMMAND); AND ๐๐๐ ๐๐๐๐๐ ๐๐๐๐๐๐๐๐๐(๐๐๐, ๐ ๐๐๐๐๐๐๐๐ ๐๐๐๐๐) FOR GROSS MISCONDUCT, ABUSE OF OFFICE, UNLAWFUL DECLARATION OF A CITIZEN AS WANTED, MEDIA TRIAL, INTIMIDATION AND VIOLATION OF DUE PROCESS
We, the Rights and Anti-Corruption Forum of Nigeria (๐๐๐๐ ๐), a legally recognized civil rights and accountability organization, write this petition on behalf of Comrade Victor Ojei, popularly known as โWong Box Nigeriaโ, who has been a victim of grave misconduct, abuse of power, and violation of due process by senior officers of the Delta State Police Command.

The officers whose actions form the subject of this petition are: - ๐๐ ๐๐ฅ๐ฎ๐๐๐ฆ๐ข ๐๐๐๐ง๐ข๐ฐ๐จ๐ง๐๐โ Commissioner of Police, Delta State.
- ๐๐๐ ๐๐๐๐ฎ๐ฅ ๐๐๐๐ฃ๐จโ Deputy Commissioner of Police (Administration), Delta State.
- ๐๐ ๐๐๐๐๐ ๐๐ซ๐ข๐ ๐ก๐ญโ Public Relations Officer (๐๐๐๐), Delta State Police Command.
- ๐๐๐ ๐๐ฆ๐๐ค๐ ๐๐ก๐๐๐ง๐๐๐ก๐จโ Divisional Police Officer, A-Division Asaba.
- ๐ ๐๐๐๐๐๐ ๐๐๐๐๐๐๐๐๐๐ ๐๐ ๐๐๐ ๐๐๐๐๐๐๐๐
On 29th August 2025, the above-named officers jointly and maliciously conspired to declare ๐๐จ๐ฆ๐ซ๐๐๐ ๐๐ข๐๐ญ๐จ๐ซ ๐๐ฃ๐๐ข (๐๐จ๐ง๐ ๐๐จ๐ฑ ๐๐ข๐ ๐๐ซ๐ข๐) wanted on the official social media handles of the Delta State Police Command, accompanied by the claim that he was โon the runโ and that a manhunt had been launched for his arrest.
Shockingly, at the exact time this false declaration was being made, Comrade Ojei was physically present inside the office of the Assistant Commissioner of Police, State Intelligence Department (๐๐๐) at the Delta State Police Headquarters, Asaba, where he had been invited for an official meeting.
Despite being within their premises, these officers knowingly and maliciously misled the public through the Police Commandโs verified accounts by declaring him โ๐ฐ๐๐ง๐ญ๐๐โ and alleging that he had absconded.
Subsequently, ๐๐๐ ๐๐๐๐ฎ๐ฅ ๐๐๐๐ฃ๐จ unlawfully directed the ๐๐๐ at the State Intelligence Department to hand over all petitions (including those already approved for investigation by the Commissioner of Police) to ๐๐๐ Emeka Iheanacho, the same ๐๐๐ who was previously petitioned by Comrade Ojei for bias and compromise in the handling of a prior case. This act clearly demonstrates conflict of interest and deliberate obstruction of justice. Kindly take note that Police Divisions lacks the capacity to treat petitions, their capacity is to entertain and address complaints or to incident cases.
Furthermore, ๐๐ ๐๐๐๐๐ ๐๐ซ๐ข๐ ๐ก๐ญ, acting in his personal capacity but leveraging his official office as the Commandโs ๐๐๐๐, publicly threatened the complainant with a media trial and subsequently published an unlawful video of Comrade Ojei obtained without consent in his private home at Asaba, Delta State. He went further to facilitate the circulation of the video and defamatory materials across blogs, online platforms, and traditional media channels with the aim of misrepresenting and destroying the reputation of the complainant before the public.
These actions have subjected Comrade Ojei to public ridicule, defamation, psychological distress, and a violation of his constitutional rights to dignity, fair hearing, and presumption of innocence.
- ๐๐๐๐๐ ๐๐๐ ๐๐๐๐๐๐๐๐๐๐๐๐ ๐๐๐๐๐๐๐๐ ๐๐๐๐๐๐๐๐๐
The conduct of the above officers violates multiple provisions of Nigerian law, including but not limited to the following:
(a) ๐๐ข๐ ๐๐ซ๐ข๐ ๐๐จ๐ฅ๐ข๐๐ ๐๐๐ญ, 2020
- ๐๐๐๐ญ๐ข๐จ๐ง 1(2): Mandates every Police officer to uphold discipline, integrity, and respect for rule of law.
- ๐๐๐๐ญ๐ข๐จ๐ง 8(2)(๐): Requires all officers to maintain neutrality and not abuse office or engage in conduct that brings the Force into disrepute.
- ๐๐๐๐ญ๐ข๐จ๐ง 24(2)(๐): Prohibits public statements or actions that embarrass the Force or violate the rights of any citizen.
- ๐๐๐๐ญ๐ข๐จ๐ง 91: Outlines disciplinary measures for misconduct, including abuse of authority and false publication.
(b) ๐๐จ๐ฅ๐ข๐๐ ๐๐๐ ๐ฎ๐ฅ๐๐ญ๐ข๐จ๐ง๐ฌ (๐๐๐ฉ P19 ๐๐ ๐ 2004)
- ๐๐๐ซ๐๐ ๐ซ๐๐ฉ๐ก 370โ373: Forbid Police officers from issuing unguarded public statements or declarations that ridicule or embarrass the Force or violate citizensโ rights.
- ๐๐๐ซ๐๐ ๐ซ๐๐ฉ๐ก 377: Categorizes false public declarations and misuse of official information as serious misconduct punishable by suspension, reduction in rank, or dismissal.
(c) Administration of Criminal Justice Act (๐๐๐๐) 2015
- ๐๐๐๐ญ๐ข๐จ๐ง 2(1): States that the purpose of the Act is to ensure efficient management of the criminal justice system and protection of suspectsโ rights.
- ๐๐๐๐ญ๐ข๐จ๐ง 8: Guarantees the presumption of innocence.
- ๐๐๐๐ญ๐ข๐จ๐ง 15(1): Requires humane treatment of suspects and prohibits any form of humiliation or exposure to public ridicule.
- ๐๐๐๐ญ๐ข๐จ๐ง 300: Prohibits public dissemination of evidence or information that could prejudice fair trial proceedings.
(d) Constitution of the Federal Republic of Nigeria (1999, as amended)
- ๐๐๐๐ญ๐ข๐จ๐ง 34(1): Protects the dignity of every citizen.
- ๐๐๐๐ญ๐ข๐จ๐ง 36(5): Guarantees that every suspect is presumed innocent until proven guilty.
- ๐๐๐๐ญ๐ข๐จ๐ง 39 & 46: Provide the right to seek redress for violations of fundamental rights.
(e) ๐๐๐๐ ๐๐๐ญ 2000, Corrupt Practices and Other Related Offences Act
- ๐๐๐๐ญ๐ข๐จ๐ง 19: Defines abuse of office as using official position to confer unfair advantage or to injure another person.
The conduct of these officers, using their offices to defame, intimidate, and destroy a citizen, squarely constitutes abuse of office and misuse of public power under this section.
- ๐๐๐๐๐๐๐๐๐๐ ๐๐ ๐๐๐๐๐๐๐๐๐ ๐ ๐๐๐๐๐๐๐ ๐๐๐๐๐๐ ๐๐๐๐๐๐๐ ๐๐๐ ๐๐๐๐๐๐๐
Under Nigerian law, a person can only be declared wanted after:
- A warrant of arrest has been issued by a competent court; and
- The person cannot be located or apprehended after reasonable efforts by the Police.
The ๐๐จ๐ฅ๐ข๐๐ ๐๐๐ญ, ๐๐๐๐ 2015, and judicial precedent make it clear that a โwantedโ declaration cannot lawfully be made through social media or press release without prior court authorization.
By declaring ๐๐จ๐ฆ๐ซ๐๐๐ ๐๐ข๐๐ญ๐จ๐ซ ๐๐ฃ๐๐ข wanted while he was physically in the custody and office of the Police, the officers grossly violated due process and abused their powers.

The act of releasing the complainantโs image and video to the public without consent and before any legal charge or trial, violates the Administration of Criminal Justice Act (๐๐๐๐ญ๐ข๐จ๐ง๐ฌ 8, 15, 300) and the constitutional presumption of innocence.
Such conduct constitutes โmedia trialโ, a practice explicitly condemned by the judiciary, the Ministry of Justice, and the Police Service Commission as unprofessional, unethical, and prejudicial to justice.

In light of these grave violations, the Rights and Anti-Corruption Forum of Nigeria (RACFN) on behalf of Comrade Victor Ojei (Wong Box Nigeria) demands as follows:
- Immediate suspension and disciplinary investigation of all officers named in this petition in line with Sections 91 and 92 of the Police Act, 2020.
- Withdrawal and public retraction of the false โwantedโ declaration and social-media publications made on 29th August 2025.
- Formal apology from the Delta State Police Command to Comrade Victor Ojei.
- Investigation by the ๐๐๐๐ into the abuse of office and misuse of official position for personal vendetta.
- Reassignment of all pending petitions of the complainant to a neutral and independent police division or state command or zonal office.
- Public guidance from the ๐๐๐๐ฌ office prohibiting future unauthorized โwantedโ declarations or media trials by PPROs and divisional commands.
Finally the events of 29th August 2025 represent a dangerous precedent of power abuse and disregard for the rule of law within the Nigeria Police Force. No officer, regardless of rank, is above the Constitution. The arbitrary declaration of citizens as โwantedโ, the misuse of Police media channels, and the deployment of intimidation tactics must be confronted decisively if public confidence in the Force is to be restored.
We trust that your esteemed office will act promptly and transparently to restore the integrity of the Nigeria Police Force and ensure that justice, fairness, and accountability prevail.
